As an employee, you determine the start and end times of your holiday (days) in consultation with your employer. It is important to request the holiday in good time from your employer. In hospitality, according to the CLA hospitality, you are entitled to three consecutive weeks of holiday. This can be limited to two weeks if the work necessitates it. In that case, you are entitled to another week of consecutive holiday.
In some cases, the employer may indicate that you cannot request a holiday in certain months or during the peak season. The employer cannot pre-determine this without agreement. This is only allowed if it is stipulated in your contract. A busy period or structural understaffing alone is not a reason to reject a holiday request. The circumstances of the case must always be considered, and a balance of interests must always be made. It is best to submit your holiday request in writing (for example, via e-e-mail or WhatsApp). If the employer rejects your holiday, you can have the rejection reviewed by a legal expert.
