Refusal of sickness notification

12-05-2022

I have reported myself sick, but my employer refuses to accept my sick report. What should I do now?

When your sick report is not accepted, it creates a difficult situation. After all, you have your reason for reporting sick and, if your report is justified, you are not able to work. The principle is that an employer accepts the sick report of their employee. It is not for the employer to judge whether the sick report is justified, as your employer is not a medical specialist and cannot assess the sick report. Only an occupational health physician or company doctor is authorised to make this assessment.

In case of doubt, the employer can refer you to the company doctor. Suppose your manager still does not accept your sick report, then take the following steps:

  • Inform them by e-e-mail or registered letter that you are sick and from which date.
  • Ask your employer for a consultation with the company doctor or contact them yourself.
  • Let them know on which phone number you can be reached.

Preventive consultation with the company doctor

You are always allowed to request an appointment with the company doctor or occupational health physician. This is also possible if there is no Updates issue of incapacity for work and absence. It is possible within the framework of the ‘preventive consultation’ if, for example, you are concerned about your health in relation to work. In principle, you could also make this appointment directly with the company doctor without the intervention of your employer. The company doctor can also provide preventive advice.
