How does it work again with roster-free and ADV days?
Roster-free days
According to the CLA catering, roster-free days from the catering CLA are generally always taken or scheduled in the year they are accrued. Article 22 of the CLA catering states that you are entitled to 13 roster-free days based on a full-time employment contract.
In November, six roster-free days must be agreed upon for the following year. Additionally, the employer may reserve four roster-free days per year to compensate for deficit hours based on article 17a of the catering CLA. If a roster-free day is not needed to compensate for the deficit hours, the employer may schedule the roster-free day in the upcoming quarter. This day must be scheduled within 14 days after the end of the quarter.
The employer can also collectively determine three roster-free days per location (article 22 section 4).
Reduction of working hours (ADV)
To ensure that older employees remain fit and enjoy going to work, employees aged 55 and over are entitled to a reduction of working hours (ADV). The older you are, the more ADV hours you receive. The same rules apply to these days as for roster-free days.
If these hours are not determined in November for the following year, this may no longer be allowed.
