Every organisation with at least 50 employees is required to establish a works council (OR). The establishment of a works council is the responsibility of the employer. However, as an employee, you can also take the initiative yourself.
De Horecabond can provide help and advice when setting up a works council. Or if necessary, we can speak with your employer if they do not wish to establish a works council.
(Provisional) regulations
If a works council is established, provisional regulations must be drawn up to govern the procedures and election process of the council. According to the works councils Act (WOR), a union must be involved in the provisional regulations of the works council.
The content of the regulations must meet certain requirements from the WOR. However, there is room to draft the regulations in a way that suits your company. The model regulations from the SER or the online tool 'customised works council regulations' can assist in drafting provisional regulations. They translate the legal requirements best into practice.
Employee representation
Enterprises with ten to 50 employees can voluntarily set up a works council. If there is insufficient interest in a works council, an employee representation (PVT) can be established. Employers are obliged to do this when a majority of employees request it. Companies with fewer than ten employees can establish a PVT on a voluntary basis.
