After closure, no salary received for two months

Achmed works in a restaurant that is being closed by order of the mayor.

Achmed has been working as a head chef in a restaurant for over four years. In July, the restaurant is closed due to noise disturbance. For the first two months, he still receives his salary on time and in full. After that, it stops.

What did De Horecabond do?

Achmed initially tried to speak to his employer about the salary himself. After several unsuccessful attempts, he contacted De Horecabond.

As he is a member, he could rely on legal assistance and support.

Achmed had not received his salary for September and October. Therefore, one of our lawyers filed a salary claim with his employer.

However, there was no response to our letters either. Therefore, we initiated a legal procedure. We claimed the outstanding salary for September and October. Subsequently, Achmed received the salary for September and October after all.

The situation remained unclear because Achmed's employment had not yet been terminated. Therefore, we contacted the employer's lawyer. They informed us that the employer could no longer meet his obligations.

As the employment ended at the employer's initiative, Achmed could apply for unemployment benefits (WW) from the UWV.
